These Terms and Conditions apply to all purchases, services, and interactions with Payless Paints (“we”, “us”, “our”). By purchasing products, using our services, or accessing our website, you agree to these Terms.

 

General

Payless Paints supplies paint, coatings, wallpaper, and related products to trade and retail customers. All products are sold subject to availability. We reserve the right to update product ranges, specifications, and pricing at any time without notice.

 

Pricing and Payment

  • All prices are shown in New Zealand Dollars (NZD) and include GST unless stated otherwise.

  • Prices may change without notice. The price charged will be the price at the time of purchase.

  • Payment is required in full at the time of purchase unless a prior trade account arrangement is in place.

  • Accepted payment methods may include EFTPOS, credit card, bank transfer, or other methods as advised in-store or online.

 

Orders and Supply

  • Orders are subject to stock availability. If a product is unavailable, we will advise you as soon as reasonably possible.

  • Special orders, custom-tinted products, and made-to-order items cannot be cancelled once processing has begun.

  • Estimated delivery or collection times are provided as a guide only and are not guaranteed.

 

Returns and Refunds

  • Refunds or exchanges are provided in accordance with the Consumer Guarantees Act 1993.

  • Custom-tinted paint, special-order products, and clearance items are non-refundable unless faulty.

  • Returns must be accompanied by proof of purchase.

  • Products must be returned unused, in original condition, and in original packaging where applicable.

 

Product Use and Advice

  • All technical advice, product recommendations, and coverage estimates are provided in good faith but without guarantee.

  • It is the customer’s responsibility to ensure products are suitable for the intended application and surface conditions.

  • Application instructions, safety data sheets (SDS), and manufacturer guidelines must be followed at all times.

  • We are not responsible for issues arising from incorrect surface preparation, application, or environmental conditions.

 

Colour Accuracy

  • Colour samples, charts, and digital representations are indicative only.

  • Variations may occur due to substrate, lighting, application method, and batch differences.

  • Customers are strongly advised to test colours before full application.

 

Trade Accounts

  • Trade accounts are subject to approval and may have agreed credit limits and payment terms.

  • Overdue accounts may incur interest, fees, or suspension of account privileges.

  • We reserve the right to withdraw or amend trade account terms at any time.

 

Limitation of Liability

  • To the maximum extent permitted by law, Payless Paints is not liable for indirect, incidental, or consequential losses.

  • Our liability for any claim is limited to the replacement of the product or refund of the purchase price.

  • Nothing in these Terms limits rights under the Consumer Guarantees Act where applicable.

 

Website Use

  • Website content is provided for general information only and may be updated at any time.

  • We do not guarantee that the website will be error-free or uninterrupted.

  • Unauthorised use of website content, images, or branding is prohibited.

 

Privacy

Personal information is handled in accordance with our Privacy Policy and applicable New Zealand privacy laws.

 

Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
